C. Information from Your Mobile Device. If you use our Services on your mobile device, we may
also collect information that includes:
 Your telephone number;
 Your geolocation;
 Your mobile contacts; and
 Information about Moon Gaming and/or other third-party apps you have on your
Device.D. Information About Your Contacts. We may give you the ability to import your address book
contacts or manually enter them so that you can locate your contacts on Moon Gaming and/or
invite them to join our Services. We may employ various techniques in order to enable you to
invite your friends so that you can more readily ask your contacts to join and/or communicate
with you through the Services. With your permission, we will access your address book, and
import your contacts’ names, email addresses, phone numbers, images, geolocation details
and any other information associated with your contacts to determine, among other things,
which of your friends do not use our Services. You are responsible for getting your contacts’
permission when you opt to give their contact details to us. We may also get information about
you from other Moon Gaming users importing or entering their contacts. If you want to remove
your contacts stored by us, follow the instructions provided in the game to request that we
remove them from our systems.
E. Information From Using Our Communications Features. You may share information with other
Moon Gaming players by:
 Participating in player forums and message boards;
 Posting public comments to other players’ profiles;
 Sending private messages or invitations to other players; Chatting with other players;
and/or
 Posting photos, drawings, or any other media.
You acknowledge and expressly agree that we may access, record and/or store archives of
these communications, comments, photos, and/or other media on Moon Gaming’s servers to
make use of them to:
 protect the safety and well-being of our players and Moon Gaming’s rights and
property in connection with our Services;
 conduct research;
 operate, improve, personalize, and optimize our Services and our players’
experiences, including through the use of analytics; and
 manage and deliver contextual advertising.F. Payment Information. If you purchase items or services in connection with our Services, our
third-party payment processor will collect the billing and financial information it needs to
process your charges. This may include your postal address, email address and financial
information. Moon Gaming does not collect or store your financial information, like credit card
numbers. However, Moon Gaming’s payment processors may share non-financial information
with us related to your purchases, like your name, billing address and the items purchased in
order to fulfill your order.
G. Customer Support. Except as provided herein, when you ask for help from our customer
support team, we may collect and store any information you give them, including your name
and email address, information regarding your use of our Website and Services, and your
Moon Gaming account. We will also store the communications you have with the customer
support team and any information in those communications in order to provide support and

3. How We Share Your Information
We may disclose or publish de-identified and/or aggregated information and other non-personal
information about our players for purposes such as industry analysis, demographic profiling,
marketing, analytics, advertising, and other purposes. In addition, we may share your information with
third parties or allow third parties to collect information from our Services in the following
circumstances:
A. Obtained Consent. With your consent, we may share your information with third parties or
allow them to collect your information from our Services in some ways not specifically
described in this Privacy Policy.B. With Friends and Other Moon Gaming Players. The Services support and often encourage you
to interact with other players. Other players, regardless of whether they are your social
network friends or not, may be able to see descriptions of your game activity, communicate
with you within our Services, and view your game profile, which may include your username
and your profile photo.
C. Third-Party Advertising. We do not actively share your personal information with third-party
advertisers for their direct marketing purposes unless you give us your consent. When
advertisers or ad networks place ads in our Services, they may collect or we may share
information, including the following, from our Services:

 Aggregated and/or de-identified information about you and other players collectively
that is not intended to specifically identify you;
 Certain technical information regarding your device used to access the Services; and

 To personalize your experience by showing you advertisements for products and
services that are more likely to appeal to you; and/or

Advertisers or ad networks may collect this information through the use of tracking

technology or multiple tracking technologies at the same time. In the event you click on a third-
party advertisement, you will no longer be on a site hosted by Moon Gaming, and that third-

not responsible for and do not have control over any third party in this respect.

a merger, acquisition by another company, or sale of all or part of our assets, we may disclose

A. Information We Receive From a Third Party. To manage the information Moon Gaming
receives about you from a third-party application used to access our Services, you will need to
follow the instructions of the third-party application for updating your information and changing
your privacy settings. Once Moon Gaming receives your information from a third-party
application or your mobile device, that information is stored and used by Moon Gaming in
accordance with this Privacy Policy.
B. Accessing and Updating Your Information Held by Moon Gaming. If you want to review, delete,

C. Stop Sharing of Your Information. If you no longer want Moon Gaming to make active use of
your information, you may send an email to [hello@moonpoker.com]. We will respond to your
request as soon as practical. Please note that certain records, including, but not limited to,
those relating to payments or customer service matters, will be held for legal and accounting
purposes. Also, if you have shared content through, or posted content on, the Service, such
content may not be able to be deleted.
D. Opting Out of Geolocation. If you have previously allowed us to access your geolocation data,
you can stop making geolocation available to us by visiting your device’s settings or the
“settings” page on the Website. Please note that as a result of opting out of geolocation, you
may not be able to access certain Services via the Website or Application.
E. Opting Out of Marketing Emails / Communications. If you want to stop receiving marketing
emails and/or other communications from Moon Gaming, click on the “unsubscribe” link in any
email from Moon Gaming. Once we receive your request, it may take an additional period of
time for your opt-out to become effective. You may not opt out of certain communications, such
as those required to provide you notice of any updates to the Services and/or Website.5. Your Privacy Rights

6. Our Policies Concerning Children
We are committed to complying with the laws protecting the privacy of children, including the United

7. Canada Anti-Spam Legislation (CASL)We are committed to complying with Canada’s Anti-Spam Law as it may be amended from time to

shall comply with the requirements of Canada’s Anti-Spam Law, including, without limitation:
 Sender identification, and sender contact information;
 Any unsubscribe mechanism;
 The processing of requests to no longer receive CEMs; and
 Ensuring that any CEM you receive from us includes a descriptive subject line consistent with
the purpose for our contacting you.
If you choose to ‘unsubscribe’, Moon Gaming will no longer be able to communicate with you by
electronic means. When you unsubscribe using the links provided in our CEMs, your request will be
processed as soon as possible, and no later than 10 business days after you send the request.
8. Note to International Users
This Privacy Policy is intended to cover collection of information in accordance with the applicable
law(s) of Canada. Some countries may require stricter privacy policies than those described herein. If
you are accessing the Website and/or Services from a foreign country, you understand and agree that
your information may be transferred to, stored, and processed in our home jurisdiction or the
jurisdiction of the third parties described herein, and that the data protection and other laws of our

reserve the right to maintain your information as part of our standard back-up procedures in an

delete, erase, or convert it to an anonymous form.

12. Governing Law and Arbitration
This Privacy Policy shall be construed and enforced in accordance with the laws of the Province of
Ontario, without regard to any conflict of law provisions. Any dispute over privacy is subject to the
provisions of this Privacy Policy and our Terms and Conditions. You waive any right you may have to
start or participate in, and agree to opt out of, any class action or other representative proceeding
against Moon Gaming arising from or relating to the Website, the Application, the Services, and/or any
of Moon Gaming’s policies and terms. Any controversy or claim alleged or commenced by you arising
out of or relating to the Website, the Application, the Services, and/or any of Moon Gaming’s policies
and terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of
the ADR Institute of Canada (ADRIC) before a single arbitrator. Any such controversy or claim shall be
arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or
controversy of any other party. The arbitration shall be conducted in Ontario. The arbitrator shall not
have the authority, power, or right to alter, change, amend, modify, add, or subtract from any provision
of these Terms. The arbitrator shall have the power to issue mandatory orders and restraining orders
in connection with the arbitration. The award rendered by the arbitrator shall be final and binding on
the parties, and judgment may be entered thereon in any court of competent jurisdiction. You may opt-
out of the above agreement to arbitrate by contacting us at [hello@moonpoker.com] within thirty (30)
days following registration of your Account. Any attempts to opt-out of this agreement to arbitrate after
thirty (30) days shall be void. Moon Gaming may seek any interim or preliminary relief from a court of
competent jurisdiction necessary to protect Moon Gaming’s rights or property, in addition to any other
relief or action which may be necessary in Moon Gaming’s sole discretion pending the completion of
any arbitration.
13. Severability
If any provision contained in this Privacy Policy is held by any competent authority to be invalid or
unenforceable in whole or in part, it shall, insofar as it is severable from the remainder of the Privacy
Policy, be deemed to be omitted from the Privacy Policy, and the validity of the other provisions
contained in this Privacy Policy and the remainder of the provision in question shall not be affected
thereby.
